The Madras High Court has dismissed a petition by film maker M.Perarasu seeking to quash an order of September 2007 of the Judicial Magistrate, Bhavani, directing Perarasu to pay Rs.10,000 to ex-wife Shanthi and Rs.5,000 to his daughter Vruthika , per month towards maintenance.
Perarasu who skyrocketed in to fame with ‘Thirupachi’ and ‘Sivakasi’ married Shanthi in the year 2000 and the couple have a daughter named Vridhika.
After few years of married life the couple developed irreconcilable differences among themself, and in 2005 Shanthi preferred to move to her mother’s place and reside there with the child.
Shanthi also had filed a petition for restitution of conjugal rights but Perarasu had obtained an ex parte order of divorce as Shanthi did not appear in front of the court to pursue the case. But the lower court had ordered payment of maintenance to Santhi, the director’s wife and daughter, Viruthika, on a petition moved by the former.
In his order, Justice T.Sudanthiram said that from Shanthi’s evidence, it was established that she was neglected by her husband and was forced to leave in her matrimonial home. The director had not chosen to come forward to controvert the evidence of his wife and the trial court accepted her evidence.
Also the maintenance amount was not excessive. So there was no merit in his petition, the Judge said.
